Summary

In June 11, 2024, Dimes San Diego, LLC (“Dimes”) entered into a written contract with Pterodactyl Tactics, LLC and its president Marc Tchamanian to purchase a 2002 Nissan Skyline GT-R M-Spec Nür (the “Skyline”). Dimes paid a total of $300,000, including a service fee, to Pterodactyl Tactics for the vehicle.
The complaint alleges that Pterodactyl Tactics and Marc Tchamanian represented they had good and valid title to the Skyline and authority to sell it, and that the vehicle would be shipped to Los Angeles within the time period set forth in the contract. The contract further provided that if the vehicle was not delivered within 120 days of payment, Dimes was entitled to a full refund regardless of the reason for delay.
As is detailed in the Court documents, Dimes asserts that although it signed the purchase contract and paid for the Skyline, the vehicle was never delivered. The complaint further alleges that after repeated assurances regarding shipment and delivery, Dimes learned that Pterodactyl Tactics and Marc Tchamanian had never actually purchased the vehicle or held title as previously represented to Dimes. Because Dimes had paid for the Skyline, but Pterodactly Tactics/Tchamanian never delivered the vehicle, Dimes demanded that it receive a refund as was required by the contract. Although Pterodactyl Tactics/Tchamanian initially promised to refund the total purchase price, and did initially refund $10,000, they have refused to refund the remaining $290,000 purchase price.
Because Pterodactyl Tactics and Marc Tchamanian have refused to comply with the refund requirement under the purchase contract, Dimes was forced to file suit to seek recovery under the contract. The lawsuit asserts causes of action for breach of contract, intentional misrepresentation, concealment, and false promise, and seeks damages and other relief as alleged. The case is currently pending in California state court.
